1. Agreement to Terms

Welcome to Komsugum Homtelup. These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," "your") and Komsugum Homtelup ("Company," "we," "us," "our") governing your access to and use of our mobile applications, games, websites, and related services (collectively, the "Services").

By downloading, installing, accessing, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

2. Eligibility

To use our Services, you must meet the following requirements:

• Age Requirement: You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use our Services. Some games or features may have higher age requirements as indicated in their descriptions or ratings.
• Parental Consent: If you are under 18 years old (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
• Legal Capacity: You must have the legal capacity to enter into a binding agreement.
• Jurisdiction: You must not be located in a country that is subject to a government embargo or designated as a "terrorist-supporting" country, and you must not be on any government list of prohibited or restricted parties.

By using our Services, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your eligibility and terminate accounts that do not meet these requirements.

3. Account Registration and Security

3.1 Account Creation

Some features of our Services may require you to create an account. When creating an account, you agree to:

• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Not share your account or allow others to access it
• Notify us immediately of any unauthorized access or security breach

3.2 Account Responsibility

You are solely responsible for all activities that occur under your account, whether or not authorized by you. We are not liable for any loss or damage arising from unauthorized use of your account. You agree to accept responsibility for all activities that occur under your account or password.

3.3 Account Termination

We reserve the right to suspend, disable, or terminate your account at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms or our Community Guidelines
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• At our sole discretion for business reasons

Upon termination, your right to use the Services will immediately cease, and you will lose access to your account, including any virtual items, game progress, or content associated with it.

4. License to Use Services

4.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Download and install our games and applications on devices you own or control
• Access and use our Services for personal, non-commercial entertainment purposes
• Access any content, materials, or features made available through our Services

4.2 Restrictions

You agree NOT to:

• Copy, modify, distribute, sell, or lease any part of our Services
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of our software
• Remove, alter, or obscure any proprietary notices, labels, or marks

This includes adding or removing features, changing game mechanics, adjusting virtual item properties, or discontinuing games entirely. You agree that we have no obligation to provide any specific content, features, or updates.

5. Virtual Items and In-App Purchases

5.1 Virtual Items

Our Services may include virtual currencies, items, characters, upgrades, and other digital content ("Virtual Items"). You understand and agree that:

• Virtual Items have no monetary value and cannot be exchanged for real money
• Virtual Items are licensed, not sold, and remain our property
• We may modify, remove, or expire Virtual Items at any time
• Virtual Items are non-transferable and may only be used within the specific game or app
• You have no property interest in Virtual Items
• Virtual Items cannot be inherited or transferred upon account termination or user death

5.2 Purchases

When you make a purchase within our Services:

• All purchases are final and non-refundable, except as required by applicable law or platform policies
• Prices are subject to change without notice
• Taxes may apply and are your responsibility
• Purchases are processed by third-party platforms (Apple App Store, Google Play Store, etc.) and are subject to their terms
• You are responsible for all charges incurred under your account

5.3 Refund Policy

Refund requests should be directed to the platform where you made the purchase (Apple, Google, etc.). We may, at our sole discretion, provide refunds or credits in certain circumstances. Fraudulent refund requests may result in account termination and legal action.

5.4 Subscriptions

Some Services may offer subscription-based access. Subscriptions:

• Automatically renew unless canceled before the renewal date
• Can be managed and canceled through your device settings or the platform where you subscribed
• Are subject to the terms and pricing stated at the time of subscription
• May be modified in price or features with advance notice

6. User Conduct and Community Guidelines

6.1 General Conduct

When using our Services, you agree to:

• Comply with all applicable laws and regulations
• Respect other users and their rights
• Follow our Community Guidelines and any game-specific rules
• Use our Services in a manner consistent with their intended purpose

6.2 Prohibited Conduct

You agree NOT to engage in any of the following prohibited activities:

• Harassment: Bullying, threatening, stalking, or harassing other users
• Hate Speech: Content that promotes hatred or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Harmful Content: Content that is defamatory, obscene, pornographic, violent, or otherwise objectionable
• Fraud: Deceptive practices, scams, phishing, or impersonation
• Cheating: Using hacks, exploits, bots, unauthorized modifications, or third-party software to gain unfair advantages
• Real-Money Trading: Selling, trading, or transferring accounts or virtual items for real money outside of authorized channels
• Spam: Sending unsolicited messages, advertisements, or promotional content
• Privacy Violations: Collecting, harvesting, or sharing other users' personal information without consent
• Illegal Activities: Using our Services for any illegal purpose or to promote illegal activities
• Interference: Disrupting, damaging, or impairing our Services or servers

6.3 Enforcement

We reserve the right to investigate and take appropriate action against violations, including:

• Warning users about violations
• Removing or disabling content
• Temporarily or permanently suspending accounts
• Reporting illegal activities to law enforcement
• Pursuing legal remedies

7. User-Generated Content

7.1 Your Content

Our Services may allow you to create, upload, share, or submit content, including text, images, audio, video, and other materials ("User Content"). You retain ownership of your original User Content, but by submitting it, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display your User Content in connection with our Services and business.

7.2 Representations

By submitting User Content, you represent and warrant that:

• You own or have the necessary rights to the content
• Your content does not infringe any third-party rights
• Your content complies with these Terms and applicable laws
• Your content is not false, misleading, or deceptive

7.3 Monitoring and Removal

We have no obligation to monitor User Content but may do so at our discretion. We reserve the right to remove or disable any User Content that violates these Terms or that we find objectionable, without prior notice.

8. Intellectual Property

8.1 Our Intellectual Property

All content and materials available through our Services, including but not limited to games, software, text, graphics, logos, icons, images, audio, video, characters, storylines, game mechanics, and compilations thereof, are owned by us or our licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Trademarks

Komsugum Homtelup, our logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Komsugum Homtelup or its affiliates. You may not use these marks without our prior written permission.

8.3 Feedback

If you provide us with feedback, suggestions, or ideas regarding our Services ("Feedback"), you grant us an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to use the Feedback in any manner and for any purpose, including to improve our Services and create new products.

9. Third-Party Services and Content

Our Services may contain links to or integrate with third-party websites, applications, or services ("Third-Party Services"). We do not control and are not responsible for Third-Party Services, including their content, privacy practices, or availability.

Your use of Third-Party Services is at your own risk and subject to their respective terms and policies. We encourage you to review the terms and privacy policies of any Third-Party Services you access through our Services.

10. Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our privacy practices as described in the Privacy Policy.

You agree to indemnify, defend, and hold harmless Komsugum Homtelup, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of our Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content
• Your violation of any applicable laws or regulations

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense.

13. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Services will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of any content
• Warranties that defects will be corrected
• Warranties that our Services or servers are free of viruses or harmful components

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Komsugum Homtelup, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, punitive, or exemplary damages
• Loss of profits, revenue, data, goodwill, or other intangible losses
• Damages arising from unauthorized access to or alteration of your data
• Damages arising from any third-party conduct or content
• Any amounts exceeding the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD

These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, government actions, labor disputes, power failures, internet disruptions, pandemics, or other events of force majeure.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Komsugum Homtelup is incorporated, without regard to conflict of law principles.

Subject to the arbitration provisions below, you agree to submit to the personal and exclusive jurisdiction of the courts located within this jurisdiction for the resolution of any disputes arising out of these Terms or your use of the Services.

17. Dispute Resolution

17.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact us at domluhgapem@gmail.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

17.2 Binding Arbitration

If we cannot resolve the dispute informally, you and Komsugum Homtelup agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

17.3 Class Action Waiver

YOU AND Komsugum Homtelup AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than arbitration, you and Komsugum Homtelup each waive any right to a jury trial.

17.4 Exceptions

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in court for matters related to intellectual property infringement or unauthorized access to the Services.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Komsugum Homtelup regarding the Services and supersede all prior agreements and understandings.

18.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Komsugum Homtelup.

18.4 Assignment

You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. We may assign these Terms without restriction.

18.5 Notices

We may provide notices to you through the Services, email, or other reasonable means. You may provide notices to us by contacting us at domluhgapem@gmail.com.

18.6 Survival

Provisions that by their nature should survive termination of these Terms shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

19. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of these Terms
• Notify you through our Services or via email
• Provide you an opportunity to review the changes before they become effective

Your continued use of our Services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using our Services.
